(Published in the McAlester News-Capital September 4th&11th, 2016.) IN THE DISTRICT COURT OF PITTSBURG COUNTY STATE OF OKLAHOMA FIRST NATIONAL BANK&TRUST CO. OF MCALESTER Plaintiff, v. MELVIN JONES and DANA M. JONES, Defendants. CASE NO. CJ-2016-61 NOTICE OF SALE Notice is given that on the 20th day of October, 2016, at 10:00 a.m. at the front door of the County Courthouse in McAlester, Pittsburg County, the Sheriff of said county will offer for sale and sell for cash at public auction to the highest and best bidder all that certain real estate in Pittsburg County, Oklahoma, to-wit: A tract of land in Lot 4, Section 18, Township 5 North, Range 15 East of the Indian Base and Meridian, Pittsburg County, State of Oklahoma, more particularly described as follows: Commencing at the Northwest corner of Lot 4, said point also being the Northwest corner of the Trails Addition, and the Southwest corner of Eagle Ridge Addition; thence S 89° 51’ 59” E along the North line of the Trails Addition a distance of 390.33 feet; thence S 00° 10’ 20” W a distance of 71 feet to the point of beginning; thence S 89° 51’ 59” E a distance of 54.57 feet; thence S 00° 05’ 16” W a distance of 73.25 feet; thence N 89° 54’ 44” W a distance of 54.68 feet; thence N 00° 10’ 20” E a distance of 73.30 feet to the point of beginning; and The Westerly 40 feet of the Southerly 73.30 feet (plat 74 feet) of Lot 4, in Block 6, in Cardinal Heights Addition to the City of McAlester, Pittsburg County, State of Oklahoma, with a street address of 2105 Whippoorwill Avenue, McAlester, Oklahoma 74501. Said lands and tenements have been appraised according to law at the value of $150,000.00. The sale will be made pursuant to a Writ of Special Execution and Order of Sale in Foreclosure issued upon a judgment entered on August 24, 2016, in the District Court of Pittsburg County, Oklahoma, in Case No. CJ-16-61, wherein First National Bank&Trust Co. of McAlester was Plaintiff and Melvin Jones and Dana M. Jones were Defendants to satisfy a judgment against Defendants, in personam, jointly and severally, in the sum of $121,027.89 plus interest thereon at the rate of 4.520% per annum (or $14.99 per day) from November 24, 2015; late fees through March 9, 2016 in the amount of $390.60; title searching expenses in the amount of $150.00; a reasonable attorney’s fee incurred herein in the amount of $4,000.00; court costs incurred in the amount of $716.19; ad valorem taxes in the amount of $2,727.87 and insurance in the amount of $1,828.77 paid by Plaintiff; and all necessary costs, fees and expenses accruing hereafter through completion of this action plus any advancements by Plaintiff for taxes, insurance premiums or expenses necessary for the preservation of the property.
