IN THE DISTRICT COURT OF PITTSBURG COUNTY STATE OF OKLAHOMA IN THE MATTER OF THE SEIZURE AND INTENTED FORFEITURE OF: FOURTEEN THOUSAND ONE HUNDRED FORTY DOLLARS ($14,140.00) AND NO CENTS IN U.S. CURRENCY LUIS ALAIN MARTIATU RESPONDENT, CV-2016-42 APPLICATION FOR FORFEITURE COMES NOW THE STATE OF OKLAHOMA, as represented by the District Attorney within and for Pittsburg County, State of Oklahoma, and applies to the Court for an Order of Forfeiture pursuant to Title 63 O.S. Section 2-503 and 2-506. In support of this Application, the State of Oklahoma Alleges: 1. Currency found in close proximity to forfeitable substances and forfeitable drug distribution paraphernalia which are reputably presumed to be forfeitable and is therefore subject to forfeiture pursuant to Title 63 O.S. Section 2-503 (A) (7). FOURTEEN THOUSAND ONE HUNDRED FORTY DOLLARS ($14,140.00) AND NO CENTS IN U.S. CURRENCY 2. Notice pursuant to the provisions of Title 63 O.S. Section 2-506 (C) has been given to all ascertainable claimants or interested parties. 3. Said monies, upon forfeiture to the State of Oklahoma, will be deposited in the District Attorney’s Narcotics Fund, a revolving fund in the Office of the County Treasurer of Pittsburg County, State of Oklahoma, pursuant to Title 63 O.S. Section 2-506(L)(3). IN THE MATTER OF THE SEIZURE AND INTENTED FORFEITURE OF: FOURTEEN THOUSAND ONE HUNDRED FORTY DOLLARS ($14,140.00) AND NO CENTS IN U.S. CURRENCY LUIS ALAIN MARTIATU RESPONDENT, NOTICE OF SEIZURE AND INTENDED FORFEITURE IN THE NAME OF THE STATE OF OKLAHOMA: TO: Luis Alain Martiatu YOU ARE HEREBY NOTIFIED that the State of Oklahoma has seized and intends to forfeit, pursuant to the provisions of Title 63 O.S. Section 2-503 and 2-506, the above described property. The above listed property was seized during a narcotics investigation by law enforcement officers in Pittsburg County, State of Oklahoma on the 6th day of April, 2007. AS AN INTERESTED PARTY OR CLAIMANT: Within forty-five (45) days of mailing or personal service of this Notice, you must file a verified answer or claim to the property described above in this forfeiture proceeding. A hearing then will be set in the District Court within and for Pittsburg County, State of Oklahoma, during which you may present proof of your ownership or entitlement to said property. Failure to file such verified answer or claim will result in a hearing being held, without notice to you in your absence, at which time the court will hear evidence upon the fact of the State’s application and shall order the item(s), equipment, vehicle, currency, property, or weapons, forfeited to the State of Oklahoma. s/Charles B.
