NOTICE OF SHERIFF’S SALE NOTICE is hereby given that pursuant to a Special Execution and Order of Sale with Appraisement issued out of the District Court of Pittsburg County, Oklahoma, on the 15th day of June, 2016, directed to me, the Sheriff of Pittsburg County, Oklahoma, commanding me to levy and sell with appraisement the following described real property situated in Pittsburg County, Oklahoma: THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER (N/2 SW/4 SW/4) AND THE SOUTH HALF OF THE SOUTH HALF OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER (S/2 S/2 NW/4 SW/4) OF SECTION TWELVE (12), TOWNSHIP FOUR (4) NORTH, RANGE FIFTEEN (15) EAST OF THE INDIAN BASE AND MERIDIAN, PITTSBURG COUNTY, STATE OF OKLAHOMA (“Real Property”) to satisfy the in personam judgment of Arvest Bank against the Defendants, Justin E. Wimsett and Sheila D. Wimsett (collectively “Borrowers”), for default of the Promissory Note dated May 15, 2012, and in rem judgment for default of the Mortgage dated May 23, 2007, covering the real property located at: THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER (N/2 SW/4 SW/4) AND THE SOUTH HALF OF THE SOUTH HALF OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER (S/2 S/2 NW/4 SW/4) OF SECTION TWELVE (12), TOWNSHIP FOUR (4) NORTH, RANGE FIFTEEN (15) EAST OF THE INDIAN BASE AND MERIDIAN, PITTSBURG COUNTY, STATE OF OKLAHOMA (“Real Property”) in the principal amount of $52,301.93 as of October 21, 2015, prejudgment interest thereon at the daily rate of $9.75 through the date of entry of this Journal Entry of Judgment, together with all abstracting expenses, property preservation expenses, escrow expenses, late charges, inspection expenses, recording expenses, insurance premiums, taxes, assessments and all other expenses incurred prior to or during the pendency of this action, or may be hereinafter advanced by Arvest; and, attorneys’ fees and costs including poundage upon sale, and all fees, costs, and expenses incurred prior to or during the pendency of this action in the amount of $4,000.00, or may be hereinafter advanced by Arvest as the result of any bankruptcy instituted by any party Defendant, for all of which let execution be issued (“Judgment”). I will, on the 4th day of August, 2016, at the hour of 10 o’clock a.m. of said day on the First Floor of the Pittsburg County Courthouse in the City of McAlester, Oklahoma, offer for sale and sell to the highest bidder for cash in excess of two-thirds (2/3) of the appraised value of said property above described or so much thereof as will satisfy the Judgment of Arvest Bank, together with attorneys’ fees, interest and all costs accrued and accruing.
