NOTICE OF APPLICATION TO AMEND EXISTING WATER RIGHTS TO USE STREAM WATER WATER RIGHT NUMBER 1997-014 Notice is hereby given that C-Gawf Real Estate, LLC ATTN: Chris Gawf, whose address is 101 E. Shurden Industrial Blvd., Henryetta, OK 74437, has filed a petition on December 21, 2015, to amend Water Right No. 1997-014 with Oklahoma Water Resources Board, pursuant to 82 O.S. §105.1 et al and Board Rules 785:20-9-4. Currently the water right authorizes the taking and use of 784 acre-feet of water per calendar year from three points of diversion on the North Canadian River located as follows: one each in the SE NW NE and NE NE NE of Section 36, T11N, R13EIM, Okmulgee County and one in the SE SE NE of Section 31, T11N, R14EIM. McIntosh County. The water is used for the irrigation of 400 acres located in Section 36, T11N, R13EIM, Okmulgee County and in Section 31, T11N, R14EIM, McIntosh County, as more specifically described in the permit. The application to amend requests the deletion of the authorized diversion point located in the SE SE NE of Section 31, T11N, R14EIM; and the addition of one point of diversion to be located in the SW SE NE of Section 31, T11N, R14EIM, McIntosh County. All other aspects of the water right will remain the same. Any interested person may protest the application. A protest must be in writing and received by the Board and applicant no later than May 16, 2016, and contain the following: (1) name, address and phone number of the interested person; (2) the petition to which the protest relates; (3) the nature and basis of the interest of the person affected; and (4) a statement of the protest or comment, the basis therefore, and the relief sought. A hearing on this application will be scheduled and the applicant and protestant(s) shall be advised of the hearing date upon receipt of a proper protest. Protesting parties or their representatives must appear at the hearing and present the protest in order that it may be considered. Hearings are governed by Section 309 of Title 75, Section 105.11&12 of Title 82 of the Oklahoma Statutes, and the rules of the Board OAC Title 785, Chapters 4 and 20.
