(Published in the McAlester News-Capital on November 6th&13th, 2016.) IN THE DISTRICT COURT OF PITTSBURG COUNTY STATE OF OKLAHOMA IN THE MATTER OF THE ESTATE OF FRANCES ANN RAUPE PAYNE, Deceased. Judge Hogan Case No. PB-2016-144 COMBINED NOTICE TO CREDITORS AND NOTICE OF HEARING To: All persons interest in the Estate of Frances Ann Raupe Payne, Deceased: You are hereby notified that on the 11th day of January, 2017, the Petitioner, Andrea Jennings, c/o Brett D. Cable of Cable Law, PLLC, Attorney for Petitioner, filed in the District Court of Pittsburg County a Petition for Summary Administration, Appointment of Special Administrator, and Admission of Will to Probate. The Petitioner has alleged that: (a) Frances Ann Raupe Payne, Deceased, of legal age, died testate on February 16, 2013, domiciled in and residing in Riverside County, State of California; (b) Petitioner Andrea Jennings is the daughter of the Decedent; (c) The name and address of the heirs or devisees are: Andrea Jennings, 2572 Falling Oak Drive, Riverside, California, 92506 and Frances Payne Trust dated June 10, 2009, c/o Andrea Jennings, Trustee; and (c) that the total value of the Decedent’s property in Oklahoma is $37,500.00. Attached to the Petition is an instrument purporting to be a certified copy of the Last Will and Testament of the Decedent. Petitioner has asked this Court to admit the Will to probate and for other summary proceedings pursuant to 58 O.S. 245, et seq. In an Order for Combined Notice entered on the 2nd day of November, 2016, the Court found that it should dispense with the regular estate proceedings prescribed by law and order notice to creditors and issue an order for hearing upon the Petition for Summary Administration and Admission of Will to Probate, the final accounting, and petition for determination of heirs, and distribution. Pursuant to the Order for Combined Notice, all creditors having claims against Frances Ann Raupe Payne, Deceased, are required to present the same with a description of all security interests and other collateral (if any) held by each creditor with respect to such claim, to Andrea Jennings, Personal Representative, at the law offices of Cable Law, PLLC, 438 E. Carl Albert Parkway, McAlester, OK 74501, addressed to Brett D. Cable, attorney for the Personal Representative, on or before the following presentment date: December 12, 2016, or the same will be forever barred. Notice is also hereby given that a hearing will be held on the 11th day of January, 2017, at 2:30 o’clock p.m. at the Pittsburg County Courthouse, 115 E. Carl Albert Parkway, McAlester, OK 74501, before Judge Hogan. At the hearing the Court will decide whether to approve the Petition for Summary Administration and Admission of Will to Probate and the final account and petition for determination of heirs, and distribution of the Petitioner. The final account and petition for determination of heirs, and distribution will be filed herein on or before the 19th day of December, 2016. You are hereby advised that you must file objections to the Petition for Summary Administration and Admission of Will to Probate and the final account and petition for determination of heirs, and distribution at least ten (10) days before the hearing and send a copy to the Petitioner in care of her attorney, Brett D. Cable, Cable Law, PLLC, 438 E. Carl Albert Parkway, McAlester, OK 74501 or you will be deemed to have waived any objections. If you have no objections, you need not appear at the hearing or make any filings with the Court. If an objection is filed at least ten (10) days before the hearing, the Court will determine at the hearing whether the Will attached to the Petition shall be admitted to probate and whether summary proceedings are appropriate and, if so, whether the estate will be distributed and to whom the estate will be distributed.
