NOTICE IS HEREBY GIVEN that the Applicant in this Cause is requesting that the Commission pool and adjudicate the rights and equities of all oil and gas owners pursuant to Title 52, O.S. §87.1, in the Caney, Mayes, Woodford, Hunton, and Sylvan common sources of supply underlying a 640-acre horizontal unit (by the order to issue in Cause CD No. 201604931, comprised of Section 20, Township 7 North, Range 18 East, Pittsburg County, Oklahoma. NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief: that the Applicant is requesting at the hearing that the order provide that any owner electing an alternative to participation in the well drilled thereunder shall be deemed to have relinquished all of its working interest and right to drill in the unit and common source of supply named herein as to such well and any wells drilled subsequent thereto. NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief: Applicant may request at the hearing that the Order provide that as to all payments provided for out of proceeds derived from the sale of production as to any owner electing an alternative to participation in the well drilled hereunder, that such royalty proceeds shall be net royalty proceeds, after deducting therefrom each ownerâs proportionate part of all taxes and each ownerâs proportionate part of the actual costs incurred by the Operator, limited however to those deducted by the purchaser or gatherer from the contract price of the oil and gas or other substances sold, in delivering, processing, gathering, dehydrating, or otherwise making such oil and gas or other substances merchantable or marketable from the unit area. NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief: Applicant may request at the hearing that the Order provide Applicant with 365 days from the date of the Order to commence drilling operations. NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief: that the Applicant or some other party be named as operator of the horizontal unit. NOTICE IS FURTHER GIVEN that this Cause will be heard before an Administrative Law Judge on the Initial Hearing Docket at the Corporation Commission, Oklahoma City facility, Jim Thorpe Building, Oklahoma City, Oklahoma 73105, Oklahoma, at 8:30 A.M. on the 22nd day of November, 2016, and that this Notice be published as required by law and the Rules of the Commission.
